The Alabama Supreme Court has reversed a lower-court dismissal and ordered that Gulf Shores Power Sports Inc. (GSPS) may continue its lawsuit against McCarron Insurance Group, an independent agency in Orange Beach. The dealer alleges that McCarron retained unearned premiums totaling at least $75,300 after GSPS cancelled commercial insurance policies in 2023.

GSPS paid McCarron $196,463 in premiums for inland marine coverage obtained through wholesale broker Maritime Program Group (MPG). After the policies were cancelled a month later, MPG refunded $15,114 to McCarron. The dealer claims the agency never returned the remaining unearned premiums or properly applied any payments to the MPG policies, and that it retained commissions owed to GSPS.

McCarron responded by filing an interpleader, depositing the $15,114 refund with the Baldwin County Circuit Court and seeking dismissal of the suit. The trial court accepted the interpleader and dismissed the agency from the case. The Supreme Court, however, ruled that an interpleader is only appropriate when it resolves all claims against the pleading party. Because GSPS filed independent claims of negligence, wantonness, recklessness, and fraud against McCarron, the interpleader did not bar those allegations.

Justice Greg Shaw wrote that the lower court erred in dismissing McCarron and disposing of the independent liability claims. The Supreme Court issued a writ of mandamus directing the circuit court to rescind the dismissal and allow the litigation to proceed. Kevin McCarron, principal of the agency, declined to comment on the decision.

Why it matters

The ruling clarifies how interpleader actions can be used in insurance disputes, affecting agencies’ ability to shield themselves from liability.
